In the Probate Court, Estate of John Philip Hauser Deceased. Application for Probate of Will.The undersigned hereby makes application for the admission to probate of the last will and testament of John Philip Hauser late of the township of Independence of said county, deceased, and states that said testator died on or about July 19 1892, leaving Mary Ann Hauser, widow and the following married persons his not of her (?): Elizabeth Gerlogh, Sister, 41 Henry St. Cleveland, Catherine Ossmaun Sister, Shasta Co California, Elizabeth Rohde, Niece, Castle Rock, Washington, Mrs Mary Ann Hauser Applicant, Resides at Independence. Letters in the Pension File of Andrew Lewallen

Declaration of Surviving Soldier for Pension
On this 16th day of March A.D. one thousand eight hundred and seventy one. . . .Andrew Lewallen aged 77. . . .declares that he is married, that his wife's name was Milla Davis to whom he was married near Kingston Tennessee on the 30th day of November 1814. . . was drafted into Captain Richard Marshall's Company, Col. William Powell's Regiment Gen Colters Brigade Genl. Winchesters Division at Anderson in the state of Tennessee on the 1st day of November 1813 and was honorably discharged at Mobile Ala. on or about the 1st day of April 1814; . . . I was mustered into service at Washington Tenn, from thence we marched to mobile Ala. Capt Marshal's Co stopping a few days at Look Out Mountain, Tenn. Some engagements were had with the British at Mobile point after or about the time of our arrival but the fort was taken soon after our arrival, my period of Service was about six months I have received two * land warrants.

      Personally appeared before me the undersigned authority, Milla Lewallen, resident of the 3rd Civil district of said County and State who being duly sworn, deposes an says that she cannot furnish a certificate of her marriage for the reasons explained in the certificate of the clerk of Roane County Court Tenn, that she cannot furnish the affidavit of the  officer who solemnized the rites of matrimony between her and her deceased husband Andrew Lewallen, because if said officer is alive his whereabouts has been unknown to her for many years., and that she does not know of any witness now living who was present at the time of her said marriage; she further states that the best credence that she can offer to establish the fact is the testimony of two witnesses who have known her and her husband ever since, and before the time of their marriage, and who knew that they lived together as man and wife, raised a family, and continued to live together as such until the time of her husband's death, and in this behalf she will offer the evidence of John Smith and Harmon Thompson who are said to be survivors of the war of 1812

    Personally appeared before me, the undersigned authority, John Smith and Harmon Thompson, both residents of the 6th Civil district of the county of Scott and state of Tennessee, who being by me duly sworn according to law deposes as follows the said John Smith says that he is 88 5/12 years of age, and the said Harmon Thompson, says that he is 78 4/12 years of age, and that they both depose as follows and say that they were for many years well acquainted with Andrew Lewallen who was a soldier of the war of 1812, that we were well  acquainted with him before his enlistment and knew him ever since up to the time of his death. That we remember well when he was married to Milla Davis, although we were not eye witnesses but we remember when they were married and knew that they always after that time continued to live together as husband and wife and that they raised a family together and always lived together up to the time of his death in the latter part of last year. and we never heard the fact doubted or questioned but that they were lawfully married. We cannot five the precise date of their marriage but as such we can recall that it was in the year 1814, we remember that it was during the time of the war in which he participated, and further that we are not interested.

Transcription of Quit Claim Deed

Transcript of the quit claim deed signed by Dolly Rhode Umiker and her siblings:

Know all men by these presents
THAT, Dolly Rhode Umiker, widow, the grantor, for divers good causes and considerations thereunto moving, and especially for the sum of Five Dollars ($5.00) received to her full satisfaction of Alfred J. Golden, the grantee, has GIVEN, GRANTED, REVISED, RELEASED AND FOREVER QUIT-CLAIM, and do by these presents absolutely give, grant, remise, release and forever quit-claim unto the said grantee, his heirs and assigns forever, all such right and title as she, the said grantor, has or ought to have in and to the following described piece of  or parcel of land, situated in the City of Garfield Heights, County of Cuyahoga and State of Ohio:

and known as being part of Original Independence Township Tract No. I, East of the Cuyahoga River, and bounded and described as follows: Beginning in the center line of Granger Road at the Northwesterly corner of a parcel of land conveyed by Philip Stark, and others to Valentine Stark by Deed dated November 21, 1872, and recorded in Volume 204, Page 443 of Cuyahoga County records; thence Westerly along the center line of Granger Road 11 chains and 23 links, to the Easterly line of a parcel of land conveyed by Charles R Lowerie and others to F. H. Jerome by Deed dated October 4, 1906, and recorded in Volume 1076, Page 8 of Cuyahoga County Records; thence Southerly along the Easterly line of the land conveyed to Jerome, as aforesaid, 8 chains and 31 links; thence Easterly along a line parallel with the first described course 11 chains and 23 links to the Westerly line of the land conveyed to Valentine Stark, as aforesaid, thence Northerly along said westerly line 8 chains, and 21 links to the place of beginning, and containing 10 Acres of land, be the same more or less, but subject to all legal highways.

TO HAVE AND TO HOLD the premises aforesaid, with the appurtenances thereunto belonging to the sale grantee, his heirs and assign so that neither the said grantor, nor his heirs, nor any other persons claiming title through or under her, shall or will hereafter claim or demand any right or title to the premises, or any part thereof; but they and every one of them shall by these presents be excluded and forever barred.

Other signatures on the document include Herman Rhode, Tobias Rhode, and Maude Drake Rhode

It may be noted that Alfred J(acob) Golden's draft registration card identifies him as an employee of the W.P.A., and that Julius Stark was named as an individual who would always know Alfred Golden's address. Alfred Golden was born 15 April 1879 in Copley, Ohio.

Guardianship request

From the Tacoma Times, 23 Sept 1915, p 3:
ASKS A GUARDIAN
Court papers filed yesterday by Charles P Rhode in a petition for guardianship tell a strange tale of a father who disappeared, and after wandering for 25 years, returned to the son under an assumed name, getting him to take charge of a ranch in Puyallup. The father's identity was later cleared. The father, Herman Rhode, charges the son is merely trying to get possession of his land. The son answers that his father needs a guardian.



Blogger's note: I called Charles' granddaughter who agreed this must be "our" Charles and Herman. She recounts a story about how, in response to an argument between the two, Herman attempted to blow up Charles' house with dynamite.
