Declaration of Surviving Soldier for Pension
On this 16th day of March A.D. one thousand eight hundred and seventy one. . . .Andrew Lewallen aged 77. . . .declares that he is married, that his wife's name was Milla Davis to whom he was married near Kingston Tennessee on the 30th day of November 1814. . . was drafted into Captain Richard Marshall's Company, Col. William Powell's Regiment Gen Colters Brigade Genl. Winchesters Division at Anderson in the state of Tennessee on the 1st day of November 1813 and was honorably discharged at Mobile Ala. on or about the 1st day of April 1814; . . . I was mustered into service at Washington Tenn, from thence we marched to mobile Ala. Capt Marshal's Co stopping a few days at Look Out Mountain, Tenn. Some engagements were had with the British at Mobile point after or about the time of our arrival but the fort was taken soon after our arrival, my period of Service was about six months I have received two * land warrants.

Personally appeared before me the undersigned authority, Milla Lewallen, resident of the 3rd Civil district of said County and State who being duly sworn, deposes an says that she cannot furnish a certificate of her marriage for the reasons explained in the certificate of the clerk of Roane County Court Tenn, that she cannot furnish the affidavit of the officer who solemnized the rites of matrimony between her and her deceased husband Andrew Lewallen, because if said officer is alive his whereabouts has been unknown to her for many years., and that she does not know of any witness now living who was present at the time of her said marriage; she further states that the best credence that she can offer to establish the fact is the testimony of two witnesses who have known her and her husband ever since, and before the time of their marriage, and who knew that they lived together as man and wife, raised a family, and continued to live together as such until the time of her husband's death, and in this behalf she will offer the evidence of John Smith and Harmon Thompson who are said to be survivors of the war of 1812

Personally appeared before me, the undersigned authority, John Smith and Harmon Thompson, both residents of the 6th Civil district of the county of Scott and state of Tennessee, who being by me duly sworn according to law deposes as follows the said John Smith says that he is 88 5/12 years of age, and the said Harmon Thompson, says that he is 78 4/12 years of age, and that they both depose as follows and say that they were for many years well acquainted with Andrew Lewallen who was a soldier of the war of 1812, that we were well acquainted with him before his enlistment and knew him ever since up to the time of his death. That we remember well when he was married to Milla Davis, although we were not eye witnesses but we remember when they were married and knew that they always after that time continued to live together as husband and wife and that they raised a family together and always lived together up to the time of his death in the latter part of last year. and we never heard the fact doubted or questioned but that they were lawfully married. We cannot five the precise date of their marriage but as such we can recall that it was in the year 1814, we remember that it was during the time of the war in which he participated, and further that we are not interested.
